FMCSA New Entrant Safety Audit — 49 CFR Part 385, Subpart D

This is the order the auditor works in. Build the binder in this order and you answer most requests by handing them a tab number instead of digging. Every new entrant gets audited inside the first 12 months of operating — usually months 3 to 11.

Automatic-failure triggers — no paperwork saves you from these

  1. Operating without the required financial responsibility (no active insurance / no BMC-91X on file).
  2. No drug & alcohol testing program, or you used a driver who failed/refused a DOT test or had a 0.04+ result.
  3. Using a driver with a disqualified, suspended, revoked, or no CDL, or operating a CMV under an out-of-service order.
  4. Using a driver not medically certified, or operating a vehicle declared out-of-service before the repair was made.
  5. Failing to register for and run Clearinghouse pre-employment full queries before a driver's first dispatch.
